This Privacy Policy contains information about the collection, use, storage, treatment, and protection of personal data of the users and visitors of the NextQS platform, aiming to demonstrate absolute transparency on the matter and clarify to all interested parties about the types of data that are collected, the reasons for the collection, and the way users can manage or delete their personal information.

This Privacy Policy applies to all users and visitors of the NextQS platform and is part of the General Terms and Conditions of Use of the services provided through this platform by the company NextQS, duly registered under CNPJ no. 39.953.461/0001-14, hereinafter referred to as NEXT QUEUES DEVELOPMENT AND LICENSING OF COMPUTER PROGRAMS EIRELI.

This document was prepared in accordance with the General Data Protection Law (Law 13.709/18), the Civil Rights Framework for the Internet (Law 12.965/14) and the EU Regulation no. 2016/6790. Furthermore, the document may be updated as a result of any normative update, which is why users are invited to periodically consult this section.

For the purposes of this Privacy Policy, the following expressions have the meanings given below:

“Administrators” refer to users who use the NextQS platform for management and configuration settings (manager.nextqs.com).

“Agents” refer to users who use the applications responsible for executing the service (agent.nextqs.com).

“Organization” refers to a group of Administrators and Agents sharing resources and settings of the platform belonging to a common company.

“End Users” refer to users who use the virtual queue resources, real-time waiting tracking, virtual queue entries, and appointments through the NextQS app and website kiosk.nextqs.com.

“Visitors” refer to users who visit our commercial websites and support channels.

“Users” refer to Administrators, Agents, End Users, and Visitors.
SECTION 2 - HOW WE COLLECT PERSONAL AND SENSITIVE DATA

The personal data of Administrators, users, and Agents are collected by the platform as follows:

When Administrators or Agents create an account/profile on the NextQS platform: these data are basic identification data, such as email and full name. From them, we can identify them, in addition to ensuring greater security and well-being to their needs. Users are aware that their profile on the platform will be accessible to all other Administrators and Agents of the NextQS platform that are part of their Organization.

The personal and sensitive data of the End User and visitor are collected by the platform as follows:

When the End User uses the services on the NextQS platform to wait or schedule a service. The personal and sensitive data collected are email, mobile phone, full name, services used, details of the service, queues passed through, general information requested at check-in defined by the Administrators of the Organization, and ratings made about the service. From them, we can identify the End Customer, in addition to ensuring greater security, well-being, and suitability to their needs.

When Visitors access commercial or support pages related to NextQS: information about interaction and access are collected by the company to ensure a better experience for the visitor, for commercial contact or support. These data can deal with the keywords used in a search, page views, the URL from where the user and visitor come, the browser they use, and their access IPs, email, phone, and name among others that may be stored and retained for future communications related to the NextQS platform, commercial contact, or support.
SECTION 3 - WHAT PERSONAL AND SENSITIVE DATA DO WE COLLECT?

The personal and sensitive data collected are as follows:

Data for the creation of the account/profile on the NextQS platform: Name and email.

Data for optimization of navigation on commercial sites, support channels, and the NextQS platform: access to pages, keywords used in the search, IP address, email, name, and evaluations).

Commercial Contact and Newsletter: the email and phone provided by Visitors who choose to receive commercial contact will be collected and stored until the user requests unsubscribing.

Personal and sensitive data of End Users, when using the NextQS platform, will have the following personal and sensitive data collected: email, mobile phone, full name, services used, details of the service, queues passed through, general information requested at check-in defined by the Administrators of the Organization, and evaluations made about the service.

Data related to contracts: Upon the formalization of the contract for the provision of services of the NextQS platform and Administrators, data related to the contractual execution, including communications made between the company and the user, may be collected and stored.

Data for virtual queue tracking: End Users who choose to provide their name and mobile phone will have these data collected to receive personalized service and to receive information about their service.

Data about the service: End Users and Agents will generate data, which will be collected, regarding the type of service, dates, and time of each stage of the service, from scheduling, entering a queue, waiting time, the moment of the call for service, start of service, and end of the service.
SECTION 4 - FOR WHAT PURPOSES DO WE USE PERSONAL AND SENSITIVE DATA?

The personal and sensitive data collected and stored by the NextQS platform are intended for:

Well-being and personalization of service to End Clients: to optimize and improve the experience of End Clients in relation to scheduling services and waiting in virtual and physical queues, as well as to obtain data for the improvement of performance and quality of service performed by Agents to End Clients.

Improvements to the platform: to understand how Agents, Administrators, End Users, and Visitors use the services provided, to assist in business development and technical improvements.

Commercial: data are used to personalize the content offered and generate subsidies to the platform for sending communications, opportunities, offers, and proposals.

Support: data are used for the realization of personalized service based on history and constant improvement of services and experience of Administrators, Agents, End Users, and Visitors.

Registration data: to allow access to certain contents of the platform, exclusive to registered users.

Contract data: to provide legal security to the parties and facilitate the conclusion of business.

The processing of personal and sensitive data for purposes not provided for in this Privacy Policy will only occur upon prior communication to the user, so that the rights and obligations provided for here remain applicable.
SECTION 5 - HOW LONG IS PERSONAL DATA STORED?

Personal data is stored by the platform for the period necessary to provide the service or fulfill the purposes outlined in this document, in accordance with Article 15, Clause I of Law 13.709/18.

Data may be removed or anonymized at the user's request, except in cases where the law provides for another treatment.

Furthermore, personal and sensitive data of Users can only be preserved after the end of their treatment in the following hypotheses provided for in Article 16 of the aforementioned law:

I - compliance with a legal or regulatory obligation by the controller;

II - study by a research body, ensuring, whenever possible, the anonymization of personal data;

III - transfer to a third party, provided that the data processing requirements set forth in this Law are respected;

IV - exclusive use of the controller, prohibited access by third party, and provided that the data are anonymized.
SECTION 6 - SECURITY OF STORED PERSONAL DATA

The platform commits to applying technical and organizational measures capable of protecting personal data from unauthorized access and situations of destruction, loss, alteration, communication, or diffusion of such data.

The data are encrypted using "secure socket layer" (SSL) technology, which ensures the transmission of data securely and confidentially, so that the transmission of data occurs in an encrypted and encrypted manner.

The platform does not exempt itself from liability for fault in case of hacker or cracker attacks. The website commits to communicate the service-taking Organization in case of any security violation of its End Clients' personal data.

The stored personal and sensitive data are treated with confidentiality, within the legal limits. However, we may disclose your personal information if we are required by law to do so or if you violate our Terms of Service.
SECTION 7 - DATA SHARING

The sharing of data of Administrators, Agents, and End Users occurs only with data related to publications made by themselves. Such actions are shared publicly with other Administrators and Agents belonging to the same Organization.

The sharing of Visitor data occurs only with data related to publications made by the user themselves. Such actions are shared only internally with collaborators and service providers of NextQS.
SECTION 8 - WILL STORED PERSONAL DATA BE TRANSFERRED TO THIRD PARTIES?

Personal data of Administrators and Visitors may be shared with the following legal entity: Starled Projects based in Brazil, registered under CNPJ 09.477.497/0001-65, and SPIDER STAR TECHNOLOGY based in Portugal, registered under the corporate number 514328460. The indicated third parties receive the data as necessary to enable them to make contacts in the context of interest in the NextQS platform.

The name, email, and phone number of Administrators, Agents, and Visitors can be transferred to third-party platforms exclusively for the automation of commercial or corporate communication by collaborators of NextQS and indicated third parties.

Personal and sensitive data of End Users may be shared with the main Organization taking the service provided by NextQS and will be subject to its own privacy policy. We are not responsible for the privacy practices of the Organizations taking our services; therefore, we encourage reading their privacy statements.

Administrators and Agents have access to personal and sensitive data among themselves and of End Users as necessary to allow them to manage and perform services through the platform.

Technology providers may be located or have facilities located in different countries. Under these conditions, the transferred personal and sensitive data may be subject to the laws of jurisdictions where the service provider or its facilities are located.

By accessing our services and providing your information, you consent to the processing, transfer, and storage of this information in other countries.

When redirected to a third-party application or website, you will no longer be governed by this Privacy Policy or our platform's Terms of Service. We are not responsible for the privacy practices of other sites and encourage you to read their privacy statements.
SECTION 9 - COOKIES OR BROWSING DATA

Cookies refer to text files sent by the platform to the user's and visitor's computer, where they are stored, containing information related to site, platform, and application navigation. Such information is related to access data such as location and time of access and is stored by the browsers of Administrators, Agents, End Users, and Visitors so that the platform server can read them later in order to personalize the platform's services.

Administrators, Agents, End Clients, and Visitors acknowledge and accept that a system of data collection through the use of cookies may be used to enhance navigation.

The persistent cookie remains on the hard disk after the browser is closed and will be used by the browser on subsequent visits. Persistent cookies can be removed by following your browser's instructions. The session cookie, on the other hand, is temporary and disappears after the browser is closed. It's possible to reset your web browser to refuse all cookies, however, some features of the platform might not function correctly if the ability to accept cookies is disabled.
SECTION 10 - CONSENT

By using the services and providing personal information on the platform, the user consents to this Privacy Policy.

Administrators, Agents, End Users, and Visitors, upon registering, acknowledge and can exercise their rights to cancel their registration, access and update their personal data, and ensure the veracity of the information provided by them.

Administrators, Agents, End Users, and Visitors have the right to withdraw their consent at any time, to do so they must contact support through our website at https://www.nextqs.com/lgpd.
SECTION 11 - CHANGES TO THIS PRIVACY POLICY

We reserve the right to modify this Privacy Policy at any time, so it is recommended that Administrators, Agents, end users, and Visitors review it frequently.

Changes and clarifications will take effect immediately upon their publication on the platform. When changes are made, users will be notified. By using the service or providing personal information after such modifications, Administrators, Agents, End Users, and Visitors demonstrate their agreement with the new norms.

In the event of a merger or sale of the platform to another company, data may be transferred to the new owners so that the services offered can continue.
SECTION 12 - JURISDICTION FOR RESOLVING CONFLICTS

For the resolution of disputes arising from this document, Brazilian Law will be fully applied.

Any disputes should be presented in the court of the jurisdiction where the company's headquarters are located.
